Entre Ríos official crashed while drunk and caused the death of 4 people

The former director of the Port Institute of Between Rivers, Juan Orricogave positive breathalyzer testThis was determined by the judicial expert within the framework of the investigation of the accident that occurred on Thursday, June 20 in the early morning on Route 39, near Caseros in the central-western area of said province.

According to official sources, the test was positive. But the level of alcohol in his blood has not yet been determined. That information will be delayed until next week, the courts said. It is a key factor for several reasons. The most important is that it could be an aggravating factor in the crime he is accused of: negligent homicide, Infobae reports.

Article 84 bis of the Penal Code, incorporated in the 2017 reform, establishes an expected penalty of between 2 and 5 years for anyone who causes a death by reckless, negligent or illegal driving of a vehicle.

In the second paragraph of the section, the penalties are aggravated and go from 3 to 6 years in prison if there are some aggravating factors. The list includes driving under the influence of alcohol if there is more than 1 gram per litre of blood. In the same sense, it incorporates the figure of “reckless negligence” when there are more than one deceased, as in this case.

In addition, the level of alcohol in the blood will determine whether or not the vehicle’s insurance covers the damage, judicial sources commented. In Entre Ríos, the rule of zero alcohol for driving applies, but insurers usually give a margin of up to one gram.

A standard policy from Iapser Seguros, the state company that insures the fleet of official vehicles, establishes among the causes of exclusion of civil liability coverage: “When the insured vehicle is driven by a person in a state of intoxication. It is understood that a person is in a state of intoxication if he or she refuses to take the alcohol test (or any other appropriate test) or when, having taken it, it returns a result equal to or greater than one gram of alcohol per thousand grams of blood at the time. of the accident.”

Patrimonial consequences

According to initial information, the VW Passat owned by the Port Institute of the province and driven by Ruiz Orrico caused the impact when crossing the lane. The vehicle was travelling on Provincial Route 39 in a west-east direction and collided head-on with the Corsa in which the brothers Lucas and Brian Izaguirre; Leonardo Almada and Axel Rossi were travelling and which was travelling in the opposite direction.

Ruiz Orrico was coming from a private party in the city of Concepción del Uruguay. The four boys were going to their work shift at the Fadel refrigerator, which operates in the town of Pronunciación.

In addition to the criminal complaint, the families of the deceased boys could initiate civil actions. In this regard, Iapser Seguros has concurrent responsibilities; the provincial government, as it is the owner of the car; the ART of the deceased, since the death occurred in itinere (that is, while they were on their way to work) and Orrico.

The first figures circulating in official offices as an assessment of the damage are in the order of millions of dollars. There is also speculation that, if necessary, the State will have to file a lawsuit against the former official to recover all or part of what it could pay for the road accident.

In addition, the State Prosecutor’s Office opened an internal investigation through the Asset Investigation Division to analyze the damage caused to the public treasury by Orrico’s destruction of the Passat and, eventually, by his irregular conduct.

Ruiz Orrico is a rural leader linked to the Rural Society. He was a three-time candidate for mayor of Concepción del Uruguay, the fifth largest city in Entre Ríos. At the first opportunity, he joined Eduardo Duhalde’s ticket in 2011. In the next two (2015 and 2019) he competed for the PRO. In all of them he lost.

He is in a relationship with Judge Evangelina Bruzzo, a member of the Criminal Court of Appeals of Concordia, with jurisdiction in the central-eastern part of Entre Ríos. The circumstance is not minor. The first prosecutor who intervened, María Occhi, excused herself because of her friendship with Bruzzo. The investigation was then passed on to Eduardo Santos.
