A 15 -year -old teenager who had been detained, accused of committing a crime and was later released by being under the age of imputability, again crime and was again deprived of his freedom.
The incident occurred in the Cólon neighborhood of the city of Córdobawhere the young man, nicknamed “The Orejudo” He tried this time, with the help of a 16 -year -old accomplice, stealing a policeman. The illicit could not be consummated since an officer could previously stop them both.
“The Orejudo” has, despite his young age, several criminal records. The most serious event occurred February 29, 2024 when he murdered Sebastián Villarreal.
That day, around 6, the 45 -year -old victim left his home, located on Fulgencio Montemayor street at 2300 in the direction of his work, a plastics company, when he was intercepted by two motochorros who threatened him with a weapon to steal his motorcycle.
“I have two children, don’t kill me,” said Villarreal. Despite the supplications and that the victim gave his shot without resistance, the thieves did not hesitate to shoot his chest twice.
Then, the aggressors escaped quickly with the two motorcycles and Villarreal was treated by residents of the area, who could not save him.
According to what the investigators, “El Orejudo”, who was 14 years old, was the one who was driving the motorcycle.
After the fact, the residents of the Yofre Norte neighborhood, where the victim lived, gathered several times to ask for justice. Different mobilizations were made both in the crime area, as in the center of the city, where the call included all relatives of victims of some episode of insecurity.
-At present, there are another four accused in the case of the young man. These are: Axel staircase, from 18 years; Héctor Herrera, from 25; Luciano Bustos, 20 and a under 17 yearsall of them accused of aggravated homicide crime cause. However, only “the orejudo” was released due to his young age.
After committing the crime, he spent several months in the Esperanza complex, the only place throughout the province of Córdoba enabled to house minors in conflict with the law. He was released in September 2024 and now with this new illicit they stopped him again.
Meanwhile, in Congress the decrease in the age of imputability that drives the ruling is treated. The Government proposes to take to 13 years punishability, however, for the moment there is no agreement between political forces about different aspects of the issue.
Due to its complexity, the discussion is made in four commissions: Criminal Legislation, Justice, Family and Budget. “Not even the Base Law was so wide,” Deputy Laura Rodríguez Machado (Pro) pointed out, at the time of reactivating treatment in deputies.
In union by the homeland and the left, the criterion of preserving the age of imputability as is now in 16 years predominates. They argue that less than 1% of serious crimes in our country are committed by minors, and that this figure is further reduced in the age of 14 and 15 years.
The rest of the forces, on the other hand, agrees to make modifications, but differs on what age should be lowered.
Complexity is even greater, since legislators argue that it is not just about coinciding with a number.
The law must anticipate that crimes must be punishable and that they must correspond to it according to their severity. In which cases an internment corresponds and what could be the alternative penalties to consider. On the other hand, social reintegration policies must be contemplated to prevent young people from becoming repeat offenders.
