The authorities of the CPCE of Córdoba, through the legal area, after internalizing on a supposedly illegal action, promoted a criminal complaint in accordance with article 247 of the Criminal Code of the Nation, which sanctions the illegal exercise of a profession regulated by law.
The action of the Council originated in a particular complaint, which motivated an internal investigation through the Special Professional Supervision Commission and the Department of Legal Affairs of the Institution based on the proceedings carried out, the corresponding judicial action was promoted, giving intervention to the competent authorities.
The Public Prosecutor’s Office ordered various evidence, and recently the case reached a definition instance in which justice decided to grant the suspension of the trial to the accused. This legal figure – known as “probation” – allows the suspension of the criminal process under certain conditions, without implying the file or the definitive completion of the file. The accused should not continue to develop the activity that triggered the criminal complaint. That is, you must give in the illegal exercise of the profession.
As a particular complainant, the CPCE actively participated in the hearing held in the Control Court, ensuring that the collective interest of professional enrollment is protected. Justice ordered the accused to comply with an economic reparation in favor of the Council and perform monthly community tasks for a year.
From the Professional Council, they emphasize that the judicial resolution “reinforces the importance of respect for the norms that regulate professional practice and highlights the institutional commitment to the active defense of the rights of enrolled and society as a whole.”
