The First District Court in the State of Morelos granted an amparo to a student of the Bachelor of Medicine of the Autonomous University of the State of Morelos (UAEM), who had been discharged from his social service and who was canceled the school year corresponding to the period February 2023 – January 2024.
As part of the resolution of the Amparo 971/2023 trial, the judge ordered the educational authorities to return to the student to their academic activities and the Mexican Social Security Institute (IMSS) to restore him in his social service at the General Hospital of the Family Medical Zone number 5, located in Zacatepec de Hidalgo, Morelos.
The student promoted the amparo arguing that the decision violated his rights of hearing, education and freedom of work, since he was not adequately notified of the start of the procedure or allowed him to defend himself, present evidence or claim in his favor.
The court determined that the responsible authorities did not respect the essential formalities of the procedure, not indicating precisely the attributed conduct or offering clear motifs for the sanction. In addition, it was concluded that the student did not have access to an effective judicial resource to challenge the determination.
The sentence orders to leave the work minute of June 26, 2023, through which its academic cycle was canceled. With this resolution, the Judicial Power of the Federation reaffirms its commitment to the protection of the fundamental rights of citizens.
