The first Preparatory Investigation Court of Lurín, in charge of Judge Vilma Vidales, partially resolved in favor of the claim of Habeas Corpus filed by the Municipality of Lurín contra Lima routes and the Municipality of Limaproviding the suspension of the collection of toll in Conchan.
According to the judicial resolution, Routes de Lima violated the right to freedom of transit of Lurín’s neighbors.

“Sort Routes of Lima SAC suspend the collection of tolls in the Conchan toll unit until the measures are taken to cease the vulnerable harmful act of freedom of traffic, or until the criminal justice issues the corresponding judicial pronouncements, with quality of firm, that determine whether the concession contract and its addendas had an illicit origin or not”read in the ruling of Judge Vilma Vidales, of the 1st Court of Preparatory Investigation of Lurín.
Likewise, the judge urged the company Rutas de Lima SAC to carry out the necessary improvements on the Conchan bridge.
The mayor of Lurín, Juan Raúl Marticorena, described the judicial decision as an important step in defense of neighbors’ rights.

“This is the beginning of great news for the district, of the first section of legal struggle that with a group of professionals of the Municipality we manage to initiate and that today we won this first instance, achieving the suspension and this toll garrita is removed product of corruption, when the road was concessioned and that continues to harm many neighbors”Marticorena mentioned, who had presented a habeas corpus so that the tolls managed by Lima routes in the southern section are eliminated.
The mayor of Lurín, Juan Raúl Marticorena, said they will appeal the judgment of the court, at the point that he did not declare the suspension of the tolls of San Pedro and Arica.
“The reasoning (of the court) is that disproportionality is not accredited. In that aspect we have two days to appeal and we are going to do it,” said the mayor authority, who said there are no suitable alternate routes that allow evading the use of tolls.
“The Judiciary has suspended the toll collection in the Garita de Conchan, giving another historical ruling that is a hard blow to the corruption of Odebrecht and Susana Villarán,” said the mayor of Lima, Rafael López Aliaga.
As Municipality of Lima, we have led ourselves in this case, as in Puente Piedra, giving the reason to the affected population, he added.
