The Provincial Court of Madrid has condemned the three gang members accused of killing a young 20 -year -old boxer named Gabriel Kraus on August 19, 2021 to permanent permanent prisons reviewable. It is possible to apply this penalty because it is a murder committed within a criminal organization, Dominican Don’t Play, one of the predominant youth bands in Madrid. The convicted are the three of legal age participating in this homicide in Manada. This is Oscar B., nicknamed the beast, José Mauricio L., known as Denyal, and José Luis B., which Joseo called. Three minors were already convicted of this crime. That three permanent prisons are imposed on different individuals is a milestone, especially in the fight against the violence of youth bands.
According to the proven facts, Gabriel was that summer afternoon at the door of an apartment on Sánchez Pacheco Street with his friends celebrating a party, when he saw some young people and released them a cry of bands. He did it by Divertimento, but it was a fatal mistake, because the boys, who were members of the Dominican Don’t Play, took him for a member of the rival band. Between five and ten minutes later, the gang members returned, but this time pertrected with “at least one knife and a machete”, they demanded that he make a typical gesture of bands, to what he refused, and then they began to attack the young boxer in a group.
Gabriel, a young promise of boxing, defended himself as he could, but was not armed and overcome him widely in number, so he took little to succumb to an attack of that magnitude. A lethal stab in the heart caused him to bleed in seconds. He could take a few steps inside the house, and collapsed after telling his friends: “Look what they have done to me.” The Provincial Information Brigade assumed the investigation because from the beginning it was clear that it was a violent action of youth gangs and, thanks to an exhaustive tracking of the cameras in the area, they were able to rebuild almost span the route of the aggressors on the day of the crime, until reaching the door of Sánchez Pacheco. In these recordings, even one of the authors of the facts to walk in a clumsy manner, which for the researchers indicates that it carried a machete in the pernera.
“The aggressors were arranged to attack indiscriminately, prevailing of their numerical superiority to ensure the deadly result and without risk for their people, without leaving Gabriel’s option to defend themselves, which was at the mercy of their aggressors,” says the judicial ruling.
The geolocation of mobile phones, as well as the collection of fingerprints and DNA in the weapons used and in a garment that fell to one of the aggressors, underpinned the guilt of the accused. In addition, in the trial a former member of the Dominican Don’t Play nicknamed Puma appeared, who pointed out that all the defendants were members of the criminal group. The sentence includes the detail that some of the defendants boasted after crime and being the authors of the deadly stab, an action that highlights points within the organization of the bands. The judicial ruling speaks of a “overwhelming” evidence.
