It is worth remembering that after the murder of 3 police officers near Cañete, in the Bío Bío region, the parliamentarians of the united Constitution and Security commissions, as well as the Defense commission, took a break from their district week to discuss legislative ideas.

However, this Monday, the aforementioned commissions had to vote if they would work until the complete dispatch of RUF projectsbut the refusal of deputy Maite Orsini lowered the possibility because there was no unanimity.

“My fear is not to legislate for 12, 16, 18 hours, of course I have the disposition for that. What I am not willing to do is for the opposition to use this presidential message (project) as a Trojan horse,” he explained.

For his part, the independent-PPD deputy, Jaime Araya, said that “we want to do a serious project” and called the opposition’s idea of ​​legislating in a single session “opportunistic.”

Let us remember that the processing of the Rules for the Use of Force (RUF) was born thanks to an agreement during the creation of Law No. 21,542, the protection of Critical Infrastructure by the Armed Forces in case of serious or imminent danger.

What are the Rules of Use of Force (RUF)?

Specifically, the bill, introduced in April 2023, seeks regulate by law the use of force by the police and armed forcesfor the maintenance of public order and internal public security.

The RUF parliamentary motion consists of 19 articless and a transitional provision, structured in four titles.

For example, in article 3, it talks about the Principles that should guide the actions of the personnel of the Law Enforcement and Public Security Forces in the use of force (legality, necessity, proportionality, responsibility and rationality). ).

At the same time, it is established that they must have adequate training and training to use force in strict compliance with these principles, and with the appropriate equipment to protect their life and physical integrity or that of third parties.

Also, within the RUF, duties are regulated (such as identification, warning, gradualness and others), the degrees of resistance or aggression and the stages in the use of force.

And finally, the project contemplates a rule regarding the prohibition of torture and other cruel, inhuman or degrading treatment or punishment. At the same time, provisions are considered for a differentiated use of force with respect to children and adolescents, detained people and people in vulnerable situations.
