SAN RAFAEL, CA — A San Rafael man is accused of firing a handgun into the ground several times Monday morning outside a Canal Street apartment complex.

Officers responded to a shots fired call just after 9 am after a witness reported seeing a man shooting at the ground and throwing his gun into a vehicle. Police surrounded the apartment complex and used a drone from the Marin County Sheriff’s Office to get a better look at the car.

As officers approached the vehicle, they saw a man who appeared to be unresponsive in the driver’s seat, police said. Officers neared the car with an armored shield and asked the man to follow their directions. Police told the man did not cooperate, but officers were able to open the car door and take him into custody.

Officials identified the suspect Tuesday as Nardo Deleon, 57, of San Rafael, who police allege was intoxicated at the time of his arrest.

Investigators said 14 shell casings were found at the scene and a video provided by a witness showed Deleon handling the gun in the parking lot. Deleon was booked into jail on suspicion of criminal negligent discharging of a firearm in public, carrying a loaded firearm in public and public intoxication.
