Alberto Otárola remained in office for 440 days.
The State Attorney General’s Office, headed by Javier Pacheco Palaios, has requested, through an official letter, the initiation of preliminary proceedings against the former head of the Ministerial Cabinet Alberto Otárola Peñaranda for the alleged crime of embezzlement of use and others.
In a letter addressed to the Attorney General’s Office, the governing body of the State has also requested a preliminary investigation against Roger Arista Perea, former director of the National Directorate of State Intelligence (DINI).
«The request is made under articles 47°, 99° and 159° of the Constitution, articles 326°, 328°, 329° and 330° of the Criminal Procedure Code, articles 1°, 11° and 12° of the Organic Law of the Public Ministry, as well as numeral 18 of article 11 of the regulations of Legislative Decree No. 1326, approved Supreme Decree No. 018-2019-JUS; I request that preliminary proceedings be initiated for the alleged commission of the crime against the public administration in the form of Embezzlement of Use and against the Administration of Justice in the form of Omission of Complaint, the same as those typified in articles 382 and 407° of the Penal Code, respectively, to the detriment of the State,” the document states.
According to a journalistic report from the newspaper La República, on October 24, 2023, the security team of the Comptroller General of the Republic, Nelson Shack, detected a suspicious operation near his home. Unidentified individuals, using two vehicles and a drone, monitored the movements at the comptroller’s residence, who reported this event to the former Chief of Staff.
