On the afternoon of Friday, June 14, the decrees to the Amparo Law and the Amnesty Law were published in the Official Gazette of the Federation (DOF), the reforms of which were approved last April in Congress.

The Amnesty Law gives President Andrés Manuel López Obrador the benefit of granting direct amnesty to people subject to proceedings or sentences that provide useful elements to know the truth in relevant cases for the State.

On the other hand, the changes to the Amparo Law will prevent judges from provisionally suspending regulations and public works.

What do the decrees to the Amnesty Law and the Amparo Law indicate?

The decree to the Amparo Law indicates the reforms to articles 129 and 148, Regulatory of articles 103 and 107 of the Political Constitution of the United Mexican States.

It indicates that said articles are reformed “in matters of suspension of the claimed act and unconstitutionality of general regulations” and points out that in no case will the suspensions issued be fixed with general effects.

On the other hand, the decree to the Amnesty Law mentions the addition of an article 9 regarding the granting of amnesty directly.

By exclusive determination of the head of the Federal Executive Branch (Andrés Manuel López Obrador), the benefit of amnesty may be granted directly, without being subject to the procedure established in this order, in specific cases that meet the following conditions:

  • That the amnesty be granted to people who provide verifiable elements that are useful to know the truth of the facts in cases that are relevant to the Mexican State.
  • That criminal action has been taken against the person or persons to whom the amnesty is granted, they are being prosecuted or are sentenced for any crime.

In accordance with what is indicated in the decree, the amnesty granted under the terms indicated in the article will extinguish both the criminal actions and the sanctions imposed.

It is worth mentioning that both decrees published in the DOF come into force the following day of their publication, that is, this June 15.
