“In effect, it was determined that the Payments made by the company to the people who provided their resources do not have a reasonable financial justification.since for 2021 the business generated losses and for 2022 and 2023 the income was not sufficient to pay the fixed returns that it offered, capitalized and paid,” reads the statement from the Superfinanciera.

These operations were carried out through a business line developed mainly in the municipalities of Turbo and Apartadó in Urabá Antioquia, which had as its principle the linking of “associated” and/or “hidden partner” third parties through a so-called “participation account contract”, the purpose of which was to receive resources from the subscribers to make them participate in the economic benefits generated by the company based on banana marketing.

In one of the joint account contracts, it is stated that the purpose was the marketing and sale of Harton Premium bananas to several supermarket chains, among them Supertiendas Olímpica, it responded that CI Comercializadora y Exportadora BCM is not registered as a supplier or client, nor are its legal representatives.

“Accordingly, our accounting records do not include operations carried out with CI Comercializadora y Exportadora BCM, identified with Nit 901.493.409-1 and it is not created in our customer or creditor databases,” said that organization.
