There is still an appeal that is in that same instance, where two more judges intervene. All this is in Brazil. The study does not intervene”, he clarified immediately.
In order to clarify that the sentence is not yet final, the lawyer explained that there are still two more instances: one in the superior court, in São Paulo, and another in the Constitutional Court. “It’s still missing,” he clarified. Then he said that he communicated personally with the actor and that it was he, from his studio, who told him to leave the country. “We recommended that in Brazil you would have a justice system that was a little less poisoned by the influences”, he reviewed.
Asked about his work for the actor, Burlando clarified that he had nothing to do with the trial in Brazil. “I defended Juan initially.”he explained. “You abandoned him afterwards?” Legrand retorted. “No, I didn’t abandon him. I usually don’t abandon anyone. I was present in many proceedings that were carried out prior to the oral trial ruling. I was present at some proceedings there, and he was acquitted. And now they are all the resources that are processed in Brazil. We can’t intervene there anymore,” he apologized. “I could actually revalidate my title there.”, he immediately hypothesized.
After explaining why he recommended that Darthés not appear before the Nicaraguan Justice and instead settle in Brazil – “we saw that there are the worst prisons in the world,” he clarified -, Burlando faced one of the most direct questions of the diva. “Was it a rape?” the driver shot straight back. “Well, the Court is now talking about statutory rape,” the lawyer replied. “He says that he was consensual,” Mirtha insisted. “I don’t know what Juan is saying,” Burlando responded with a half smile on his face. “Didn’t you read it?“, Mirtha was surprised. “No. I saw something else. That’s why I tell you. Other issues were raised at the trial. Obviously there is a duty of secrecy, I do know to what limit I can speak. But what these two new judges are talking about now is a situation of statutory rape that has nothing to do with aggravated sexual abuse, as intended,” she replied.
This past Monday, Juan Darthés was sentenced to six years in prison by the Brazilian Justice in the case of aggravated sexual abuse against Thelma Fardin. The information was confirmed by sources from Amnesty International Argentina to THE NATION. Darthés will enjoy a semi-open regime, which means that the former member of the Ugly Duckling cast will be able to leave the prison during the day but must return to prison every night and sleep in his respective cell.
“The Brazilian justice system declared the actor guilty in the rape trial against Thelma Fardin. The judges sent a clear message of justice. Firm step in the fight for the rights of victims of sexual and gender violence,” reads the publication that the NGO made on X, the social network formerly known as Twitter. “In accordance with the modifications of Law No. 12,015, of 2009, in article 213 of the Penal Code, ‘force a person through violence or serious threat to have carnal relations or to practice or allow any libidinous act to be practiced with them’” , says the second instance ruling that declared Darthés guilty.
The conviction responds to the complaint that the actress made in Nicaragua, in 2018, for an event that occurred there in 2009, during a theatrical tour of the strip Ugly Duckling. At that time, Fardin was 16 years old, and Darthés, 45.
