In La Rioja, 5 thousand people retired due to the pension moratorium

The rule was approved in general on Tuesday morning, but the particular treatment is still missing to know if it is finally applied or if it undergoes any changes.

Sandra Vani, head of the Secretariat of Pension Management of La Rioja, discussed this topic and pointed out that articles 226 and 227 add the repeal of Law 27,705, which establishes the pension debt payment plan. This measure could negatively affect many people who are close to retiring and need to access it: “they would find themselves in a state of defenselessness and legal insecurity, especially those who have worked all their lives but have not made the corresponding contributions.”

Vani highlighted that the current pension moratorium, in force since March last year and which would expire in March next year, allowed some 5,000 people to retire in the province. However, he considers that the repeal of this law and the creation of the Proportional Retirement Benefit especially excludes women, raising the retirement age from 60 to 65 years for those who do not have the necessary 30 years of service. This would affect 90% of women, who currently access retirement thanks to the moratorium.

“Women are being excluded and it will affect 90% of women. Today, with the moratorium, many women are accessing retirement, but also men, because 7 out of 10 men use the moratorium to retire. If this type of tool did not exist, only one in 10 women could retire and 3 in 10 men could retire.”

In this sense, the professional warned that the text of the norm, especially article 27, is considered “deficient”, since “it delegates to the National Executive the power to set parameters for increasing the assets of women.” Furthermore, “it leaves many gaps and generates legal uncertainty.”
