Around nine in the morning this Tuesday, the Chamber of Deputies approved the Base Law by 142 votes in favor, 106 against and 5 abstentions. For their part, among the 10 Mendoza legislators there were those who supported the initiative and those who rejected it.

Beyond the political differences within Mendoza, the national legislators of Cambia Mendoza, La Unión Mendocina, the Democratic Party and La Libertad Avanza voted in favor of the Base Law: Lisandro Nieri, Pamela Verasay and Julio Cobos (Mendoza changes); Facundo Correa Llano and Mercedes Llano (P.S); lvaro Martinez (LAUM); and Lourdes Arrieta (LLA).

For their part, the three Mendoza national deputies of the Justicialist Party they voted against of the Base Law: Martín Aveiro, Liliana Paponet and Adolfo Bermejo. The vote of the latter, of Maip’s Peronism, did not coincide with the statements made months ago by the mayor of this department, Matas Stevanato, who had remarked that “it is time to accompany Milei”, since the people had chosen him for a vast majority.

Some key points of the Base Law

– Privatization measures are included within the chapter on “state reform”. The project lists companies subject to privatization as Aerolíneas Argentinas SA, Energa Argentina SA, Radio y Televisión Argentina SE, and Intercargo SAU. Additionally, Nucleoelctrica Argentina SA and Yacimientos Carbonferos de Río Turbio are included, but in these two cases it is established that the State must maintain control or a majority shareholding.

– On the other hand, it is proposed to grant private concessions to the companies Agua y Saneamientos Argentinos SA, Correo Oficial de la República Argentina SA, Belgrano Cargas y Logstica SA, Sociedad Operadora Ferroviaria SE (SOFSE) and Corredores Viales SA.

– Chapter IV addresses public employment, establishing that state unions may not deduct part of the salary of non-affiliated workers without their explicit consent. In addition, it is stipulated that those workers who participate in a strike will have the hours not worked deducted from their salary, without receiving administrative sanctions. Officials from eliminated organizations will become available for 12 months and, if they do not find another position, they will be dismissed from the National Public Administration.

– Title IV focuses on the “promotion of registered employment” in the private sector, allowing employers to regularize employment relationships prior to the law with a period of 90 days to do so. Employers will be exempt from legal actions, debts, infractions, fines and sanctions, and will be removed from the Registry of Labor Sanctions.

– Title V of labor modernization has been simplified compared to the original version. Among the main measures are the extension of the trial period and the creation of an optional severance fund, which will be determined in collective agreements as an alternative to compensation.

– Regarding the trial periods, they currently last 3 months. The proposal consists of extending them to 6 months for companies with more than 100 workers, to 8 months for SMEs with between 6 and 99 workers, and to one year for mini-SMEs with up to 5 workers.

– A company may only hire a worker under the trial period figure once. Abusive use of trial periods to prevent the hiring of a worker may result in sanctions.
