Neuquen– In a sentencing hearing held yesterday, legal assistant Luciano Vidal requested a sentence of 7 years in prison for Mauro Elio García and 6 years and 8 months for Jorge Emiliano Ariel Crocce, for a robbery that occurred in October 2023.

During the hearing, the representative of the prosecution explained that in April, by agreement, both were declared responsible for the crime of aggravated robbery for being in a town and in a gang, aggravated by the use of a firearm suitable for shooting, as co-authors (articles 166 paragraph two and second paragraph, 167 paragraph two and 45 of the Penal Code).

He also presented to the court the agreement he reached with García’s defense, which contemplated a sentence of 7 years in prison and the declaration of the first recidivism. He explained that he was previously sentenced to 3 years and 6 months in prison for carrying a weapon, theft and burglary and that that sentence ended this year.

In relation to Crocce, the official requested a sentence of 6 years and 8 months. In this case, the accused has no conviction record.

Vidal reported that the victims were informed of this agreement.

The collegiate court made up of Judge Estefanía Sauli, and Judges Mauricio Zabala and Gustavo Ravizolli, approved the agreement presented in relation to García, who was sentenced to 7 years in prison with effective compliance.

In relation to Jorge Emiliano Crocce, the sentence imposed was 6 years and 8 months of effective compliance as required by the prosecution, the defense had required 5 years.

García’s defense waived the challenge deadlines and the convicted person begins serving his sentence immediately.

Meanwhile, Crocce’s lawyer did not renounce the possibility of challenging the decision.

The fact

The theory of the case that the Public Prosecutor’s Office was able to prove was that on October 2, 2023 at approximately 6:15 p.m., in a commercial premises located in the city of Neuquén, García entered the premises along with another unidentified person, who pointed out to the victims with a firearm.

García went to the cashier area, struggled with the employees and stole the money. While his companion pointed at an employee and then shot him in the leg. They later got into the vehicle in which they were traveling, which was driven by Crocce, and fled. The victims and witnesses immediately notified police personnel.

Then the car was seen by police personnel from the Third Police Station, traveling at high speed and crossing red traffic lights. There a police chase began that ended in the Gregorio Álvarez neighborhood, where they crashed into a house. Both convicts were arrested when they tried to escape on foot.

The third unidentified person, who fired the shot, managed to escape and the stolen money or the weapon used could not be recovered.
