Could the expansion of SEOM in the Candioti neighborhood be approved automatically?

After the comings and goings over the car care issue, confusion now appears in the Municipal Ordered Parking System (SEOM)formalized by Ordinance No. 11,685 of 2010. To try to understand this intricacy, it is convenient to recount the events chronologically.

On April 5, the Executive sent Message No. 11 to the Santa Fe Council, in which it requested, ad referendum (“for consideration”) of the local Legislature, the expansion of the metered parking area provided by Decree No. 00026/ 24.

What was that decree intended? Extend the perimeter of paid parking in Candioti North and South neighborhoods: ebetween Ituzaingó streets to the south, Vélez Sarsfield to the east, Chacabuco to the north, Necochea to the west; and, on the other hand, Castellanos to the south, Necochea to the east, Chacabuco to the north and Pedro Vittori to the west..

It also established modifications to the schedules (especially extending the service at night) and, finally, provided that the extension of the service would be valid for 365 days.

It is worth clarifying here that The municipality has the power to make changes in the SEOM areas without a prior ordinancesimply through an administrative act.

New decree

But on April 24, the municipal administration headed by Dr. Juan Pablo Poletti sent another decree, No. 00030/2024, with a letter to the presidency of the Corps, headed by Adriana Molina, signed by the mayor of the capital and the secretary of Government, Control, Mobility and Citizen Security, Sebastián Mastropaolo.

“I am pleased to address you (…) for the purpose of sending you attached to this faithful copy of Decree No. 00030 dated April 24, 2024, by which articles 3 and 4 are revoked. of Decree No. 00026/24, which was submitted to said body through Message No. 11 dated April 5, 2024, all for the purpose of joint treatment,” says that letter.

In this new decree, the Executive considers it “convenient and opportune” to partially annul some of the provisions of the previous decree. Specifically, it leaves without effect articles 3 and 4 of Decree No. 00026/24.

These two articles that are “retired” refer, firstly, to the new schedules and, secondly, to the 365-day period of validity. But article 1 is not void, which provides for the expansion of the SEOM perimeter in the Candioti neighborhood and in the geographical radius mentioned above..

And then?

As El Litoral learned from different legislative sources consulted, decree No. 00030 is still in the Council. With everything, The only article that would remain in force is the extension of the perimeter of the SEOM in Candioti, with the usual hours and with the new rates, which will govern from Monday the 13th..

Authorizing the new expansion could occur in two ways: one, that the Council approves it in an ordinary session; two, that is sanctioned fictitally (“in fact, automatically”) if it is not formally treated by the Legislature within 15 days from the entry of decree No. 00030. This is what the ordinance that created SEOM provides.

Strictly speaking, article 3 of this ordinance establishes, both for rates and for changes in zones, that the metered parking modifications “will become effective if the Municipal Council does not make a ruling within 15 days of having entered the corresponding message in the secretariat during the period of sessions.”

The last element

But there is a third element, the last one in the chronological line: Last Friday, May 3, the municipality reported through its official channels that “it is not considered” to implement the Municipal Ordered Parking System (SEOM) in new neighborhoods of the city.

“There is currently no intention to incorporate more blocks with the metered parking system,” said Mastropaolo in that statement. “On this occasion we are only asking the Council for the power to be able to establish, in the future, an expansion of the SEOM, but it is not a decision to be implemented in the short term“added the official.

In technical terms, if the mayor indeed intends not to expand the metered parking area for the moment (as the official communication says), “he should withdraw that decree (No. 00030) from the Council. That official statement generated, for another legislative advisor consulted, more confusion. “Because it would seem that under no circumstances is the mayor going to expand the SEOM area.”

But “In reality, if it is approved in a fictitious way, the municipality would already have the tool authorized by the Council to be able to extend metered parking in the Candioti neighborhood, although it would not yet be implemented shortly, but in the future, judging by the letter of the official statement”he added.

It is assumed that it is the Executive who weighs the changes in urban mobility that the city requires based on certain needs. What is clearer is that the Executive would have this authorized legislative tool to expand the SEOM in Candioti, but it is not known when: in principle, it will not be soon.

One last element: What would it mean to extend the perimeter of the SEOM in the Candioti neighborhood in the current context? That new “measured” docks be established and that the payment application for the service be adapted. In fact, the municipality intends to put out to tender a new metered parking system, to modernize it technologically. But this will come later: it will be a new chapter.
