Modification in the management of labor contributions in Colombia (SGRL) – Resolution 738

The Ministry of Health and Social Protection of Colombia issued a resolution with which it has taken a significant step in the reformulation of the contribution system to the General Occupational Risk System (SGRL), with the objective of improving the precision and effectiveness in the management of these contributions. Resolution Number 738 of 2024 introduces important modifications to the Technical Annex 2 of Resolution 2388 of 2016which directly affect the way in which contributors and operators manage and validate contributions to the SGRL.

This reform focuses on optimizing the validation of contributions, where a key change is the validation of contributions to the SGRL exclusively at the contributor level, instead of the contributor. This means that membership and contributions will be reviewed and confirmed using the contributor data registered in the Transactional Membership System (SAT), which promises to improve accuracy by avoiding discrepancies in the data provided.

An additional improvement, and very necessary according to the requests of FASECOLDA representing the Occupational Risk Administrators (ARL), is the postponement of the implementation of this validation until September 1, 2024. This postponement is due to the need to guarantee that the redirection of the contribution is carried out with complete and updated information, which has been a challenge due to persistent problems in the connection and transmission of data in the SAT.

In addition, certain types of documents will be eliminated, such as the Identity Card and the Passport, for the affiliation of contributors to the SGRL, simplifying and standardizing the types of accepted documents that will now focus on documents such as the Tax Identification Number (NIT). and the Immigration Certificate.

With these adjustments, the Ministry seeks to facilitate a more efficient process and less susceptible to errors, which will not only benefit the ARLs and contributors, but will also ensure greater protection and coverage for affiliated workers. These changes reflect an ongoing effort to improve the administrative infrastructure of the social security system in Colombia, ensuring that contributions are managed more effectively and that workers’ rights are adequately safeguarded.
