The Buenos Aires Administrative and Tax Litigation Judge Elena Liberatori suspended the increase in Subway fare through a “precautionary measure” which was to come into effect from next Friday.
The judge adopted the measure – which in fact prevents the immediate application of the new tariff schedule – “until the transfer is answered, accompanied all of the required documentation.
Until this occurs, “the defendants (the Buenos Aires government and the company Sbase, ed.) They must refrain from innovating in relation to the amount of the fee to the user of the public Subway service,” the resolution maintains.
Liberatori adopted that decision “by virtue of the absence of information linked to citizen participation developed in the public hearing, specifically regarding the responses to the requirements made therein by the participants.”
Due to the procedure that governs this type of judicial actions, the judge also resolved that “given that the requested precautionary measure refers to a public service and/or essential function of the Administration, prior to resolving, transfer for a period of two days to the Government of the City of Buenos Aires and to the Subterráneos de Buenos Aires Sociedad del Estado (SBASE)”.
The measure was adopted within the framework of a protection action presented by the deputy of the Left and Workers Front (FIT) Myriam Bregmanon the rights of users and consumers.
If the Buenos Aires government and Sbase presented all the documentation and information required before Friday, the court would be in a position to resolve the proposal to suspend the fare increase before the period initially scheduled for its validity.
