Impunity in the violent sexual attack against a child, when he was 3 years old, seems like a shadow that grows increasingly larger in the case that was initiated to find the person who raped him that afternoon of March 6, 2022, in Chimbas . There were two suspects in the case: the “father” of the child and a boy, who was 16 years old and was seen by the victim’s mother when she appeared behind some sugarcane fields with the child as if wallowing in the dirt. The woman found out about the sexual attack moments later, when she arrived at her house and checked on the child because she complained. The young boy then became suspect number 1 and his family even had to move to La Rioja, because they were stoned and threatened with burning, house and everything. The scope of the investigation changed when the experts found traces of semen in the elastic waistband of the pants that the creature was wearing that day.
A DNA match with the teenager and people in the child’s inner circle forced the direction and location of the investigation to change, from the Children’s Justice Department to an Anivi prosecutor’s office. This was because the test with the young boy was negative, but surprisingly it was positive with his baker “dad” and, in addition, it revealed another piece of information that more than one person did not expect: the baby was not that man’s son.
The illuminating key to the case seemed to always lie in the child’s version, but multiple consultations with psychologists revealed that it was not feasible to obtain any information from the boy due to his notorious difficulties in expressing himself.
Two years later, prosecutor Duilio Ejarque returned to the fray with a request for the minor to testify before psychologists, something that was highly anticipated, since the boy is already 5 years old.
But the results of the interview were discouraging. According to judicial sources, the minor favored his “father” without saying anything traumatic about his coexistence with him, since he alluded to hot dogs and other things they ate. And he also did not mention his rape as one of the traumatic events of his short life, as he pointed to a blow to the forehead with glass and the fact that another boy twisted his hand as two of the violent episodes that he I remembered. Ergo, he also didn’t mention any sexual offenders.
That statement from the minor plus the fact that his mother said that on March 6 she was with her son’s “father” all morning and that that man used to clean himself with the clothes that she left in the laundry basket when they had relations, dispelled suspicions against the baker.
To the point that, now, prosecutor Duilio Ejarque asked that this man be removed forever with a dismissal. Thus, the case seems to be heading towards definitive impunity.
