The purpose of the lawsuit is to allow the sale of liquor from other departments, a mechanism that, according to the plaintiffs, would protect local production.. Currently, according to article 2 of this law, the process of production and marketing of liquor is a monopoly of the State. This is how the legislation reads: “The monopoly as a rent tax on distilled liquors is defined as the exclusive power of the State to exploit directly or through third parties the production and introduction of distilled liquors and to organize, regulate, supervise and monitor the production and introduction. of distilled liquors under the terms of this law.”

Fenalco Caldas indicated that this lawsuit could succeed because the law, according to the union, could be unconstitutional. “The Constitution in article 336 excludes the establishment of monopolies and that is why one can consider that law 1816 of 2016 could be unconstitutional,” Juan Carlos Franco, Executive Director of Fenalco.

On the other hand, the manager of the Licorera de Caldas, Diego Angelillis, in dialogue with Caracol Radio, indicated that they have effectively sought several legal entities so that the yellow liquor can be distributed in Cundinamarca. “We are waiting for the corresponding judicial actions to be resolved, to be able to enter those markets.”

Apparently the Antioquia Liquor Factory is betting that Law 1816 remains constitutional and is not betting on the free market or open borders
