The subways will stop working this Wednesday between 5 and 9 p.m.

The union that represents the workers of the Subway in the Buenos aires city announced a unemployment for this Wednesday, June 19. It will be staggered, on the different lines, between 5 and 9 p.m. The measure of force is due to a response from the leadership for the suspension of Claudio DellecarbonaraExecutive Secretary of the Union Association of Subway and Premetro Workers (AGTSyP – Metrodelegates).

The sanction to the leader, as indicated by the union, was due to his position in an old protest, in which released pinwheels and allowed users to travel without paying the corresponding fare. The force measure ordered to interrupt the service on the different lines based on the following schedule:

  • Lines B, E and Premetro: from 5 to 7 p.m.
  • Lines D and H: from 19 to 21
  • Lines A and C: from 9 p.m. to closing

“We will carry out self-defense measures in the subway and premetro as a consequence of the suspension of our colleague and member of the Executive Secretariat, Claudio Dellecarbonara, for releasing turnstiles and allowing users to travel for free during a protest measure by our union,” he reported during this Tuesday afternoon the union.

Then he added: “We demand that the company stop persecuting workers for exercising their rights, as indicated in the Constitution. We regret the inconvenience that these measures may cause to users,” concluded the statement signed by Roberto Pianelli, General Secretary, and Néstor Segovia, Deputy Secretary, of the union.

The measure of force is for retaliation against a leader

The sanction against the union leader consisted of a 15-day suspension, which was described as “an outrage” by the union. “The opening of turnstiles is common as a measure of force,” explained Andrea Salmini, press secretary of AGTSYP.

The conflict that led to the sanction against Dellecarbonara took place in 2021. On that occasion, the company was carrying out spare parts for which it had hired an outsourced company, as detailed by the union. “Those jobs corresponded to permanent staff,” Salmini added.

This difference caused a protest in which the sanctioned leader participated and ‘made it possible for users to travel without paying, within the framework of the claim. The action resulted in the outsourced company finally withdrawing and the work being carried out by employees of the permanent plant on the subway lines.

However, the discussion did not end there. Being a member of the guild. The process took a while but finally the company’s response was finalized in the last few days.

The concessionaire of the Subway service in the City of Buenos Aires, for its part, responded through a statement. “Emova reports the measure of force is completely unjustified given that a ruling by the Labor Court gave rise to a request from the company to apply a sanction to AGTSYP director Claudio Dellecarbonara, for carrying out improper actions within the framework of their work performance”.

“The National Court of First Instance of Labor No. 73 determined that Emova is in a position to suspend it for 15 days for preventing the normal development of activity in different work sectors.. The breaches occurred in the Congreso de Tucumán (D) and Alem (B) stations in December 2021, occasions in which it kept the emergency door open, encouraging hundreds of users to enter without paying a fare, causing damage to the company. Likewise, he repeatedly disobeyed the requirements of the hierarchical personnel to cease the action, which led to the sanction applied. In this case, a court ruling is required due to the union protection that the manager has,” the company continued in its argument.

“Repeated disobedience to hierarchical personnel implies a violation of their obligations as an employee of the company, which entitles them to apply disciplinary sanctions (LCT, art. 67),” confirmed the directors of the subway administrator in Buenos Aires.
