What happened?

The Court of Appeals of Valparaíso ordered that the General Treasury of the Republic return the money that was withheld from a woman for a debt from the University Credit with State Guarantee (CAE).

The affected person, who worked at the Seremi de Salud de Valparaíso, in the Quillota office, filed a labor claim against the treasury after there were differences in her settlement in the calculation of her legal holiday and no interest or adjustments were paid to her.

This judicial action was accepted and the court determined that the former Seremi de Salud worker should receive a sum of $1,093,671 from the treasury, within the framework of their labor demand.

However, the Treasury did not give the money to the affected woman and explained that it was going to be retain 100% of the amount to be able to finance the debt that the woman had for the CAE university loan.

Faced with this, the affected person filed an appeal for protection against the General Treasury of the Republic, which was accepted by the Court of Appeals of Valparaíso, according to the Judiciary.

In a unanimous ruling, the appeal court established that Treasury acted illegally and arbitrarily having withheld the amount that the plaintiff should have received for the labor benefits she provided.

Likewise, it was established that the CAE debt cannot be compensated with the labor compensation that the woman was supposed to receive, given that the money has “a different legal nature.”

The Court of Appeals accepted the appeal for protection filed by the affected person and ordered that the General Treasury of the Republic must return the money that was used to pay your CAE debt.

The court determined that the Treasury “must proceed to pay the remunerations and any other concept withheld or compensated by the respondent in favor of the plaintiff, for the amount of $1,093,671 with readjustments and interest until the date of its effective reimbursement.”
