This year the Colombian Football Federation (FCF) released a music video called “El Ritmo que nos Une” in which Ryan Castro sings along with Juan Fernando Quintero and Luis Díaz, players of the Colombian National Team. The video has more than 7 million views on YouTube, however, it could be removed from this platform due to a lawsuit that reached the Superintendence of Industry and Commerce (SIC).

According to the plaintiffs, the singer and the players of the Colombian National Team violate the rule by appearing in the video with t-shirts of the Colombian team with the logo of the gambling brand, BetPlay, in addition to betting on a part of the recording.

CON-SUMMA reported in the document that it was initially known by the W that “In this video, the singer Ryan Castro, several players from the Colombian National Team and a group of Colombian fans are shown singing and celebrating, among them several minors. At 24 seconds, the first explicit reference to online betting by cell phone appears, then at minute 1:05 the second online bet appears and then at minute 2:04 the third online bet appears. Note that the singer Ryan Castro and the fans in yellow shirts have a large allusion to the BETPLAY brand.”.

This league of consumers is requesting that the audiovisual piece include two disclaimers or warning signs, as read in the document and they clarified it on their official social networks.

Another request is that a fine be imposed on the FCF and the betting company for “violate regulations related to consumer protection and gambling advertising”.

Regarding regulations on gambling advertising, Charmaine Hogan, head of regulatory affairs at gaming platform Playtech, has said that in Colombia there is a balanced approach, where the country has chosen not to impose excessive limitations and has allowed legal gambling sites to advertise.

However, if betting is considered a product harmful to health, Law 1480 of 2011, which is known as the Consumer Statute, warns in its article 31 that “In advertising products that by their nature or components are harmful to health, the public will be clearly warned about their harmfulness”.
