Toluca Chamber of the TEPJF revokes Santiago Nieto’s candidacy for the Senate

TOLUCA, Edomex. (apro).- The Toluca Chamber of the Electoral Tribunal of the Judicial Branch of the Federation (TEPJF) declared Santiago Nieto Castillo, former head of the Financial Intelligence Unit (UIF), ineligible for the position of senator for the state of Querétaro, considering that does not comply with the residency requirement, and ordered Morena to replace the application.

The decision on the 13th and accumulated appeals of this year promoted by the National Action Party (PAN) against the agreement INE/232/2024 that endorses the registration of the second formula by the principle of relative majority in the state of Querétaro, It was taken by majority, while Judge David Avante voted against.

The majority of the magistrates considered the grievances to be founded and determined that the candidacy does not meet the eligibility requirement of effective residence of more than 6 months prior to the election.

The proof of residence and domicile recorded in the credential provided by the person registered with the INE, they indicated, is surpassed by the evidence offered by the plaintiff, among them the inconsistencies detected by the secretary of the town hall to carry out the issuance process. residence, since there are no previous records from the municipal authority.

Furthermore, they stated, in the Declaranet System it is noted that the candidate has held various public positions outside of Querétaro, continuously for years, and the last one was in Hidalgo and concluded on January 8.

The record also contains evidence of a summons procedure carried out in 2022 at the indicated address, and it was found that he did not reside at that place; and a notarial questioning of neighbors of the home that confirms what was stated.

Nieto Castillo’s social networks, they indicated, do not contradict his residence outside the entity, since for it to be effective it is not enough to prove the address, but it is also required to prove permanence.

Although the former head of the UIF argued that residence is not lost for being absent for work reasons, in the end, the majority of the plenary session determined that the above only applies at the municipal level, but not electorally, so they considered it appropriate to revoke the controversial agreement for Morena to replace the candidate declared ineligible.

“As a result of the above, the agreement of the General Council of the National Electoral Institute INE/CG232/2024 was revoked and with it the registration of Santiago Nieto Castillo as a candidate for the Senate of the Republic by the principle of relative majority, postulated by the party. Morena politician, having instead to nominate a candidacy that meets the requirements set forth for this purpose,” the Regional Chamber concluded.
