The Administrative Court of Casanare has issued a ruling in the area of electoral control, due to a complaint filed by Reyes Emilio Guanaro Vargas against Jhon Jairo Peynado Correa and the Colombian Liberal Party.
The plaintiff requested the annulment of the administrative act E 26 CON of November 4, 2023, by which the election as councilor of the municipality of Yopal was declared for Jhon Jairo Peynado Correa, for the Colombian Liberal Party, for the constitutional period 2024-2027 .
He also requested the cancellation of Peynado Correa’s credential and that the corresponding credential be granted to him, since he came in third place in his party’s vote.
The plaintiff alleged that Peynado Correa was disqualified from being a councilor due to a contract entered into with the Casanare department within the year prior to the election. He maintained that this contract gave him advantages over other candidates.
The Court examined the elements of the cause of disqualification and found that Peynado Correa entered into a contract with the department of Casanare within the year prior to the election, which was carried out mainly in the municipality of Yopal. Furthermore, he received fees for this contract, demonstrating a proprietary interest.
The Court declared the partial annulment of the act of election of Peynado Correa as councilor of Yopal for the period 2024-2027. He ordered the cancellation of his credentials and denied the plaintiff’s other claims.
Once the sentence is enforceable, it will be notified to the parties and the Public Ministry. In addition, it will be communicated to the Municipal Council of Yopal, the National Electoral Council and the Ministry of the Interior. The file will be archived once the corresponding formalities have been completed.
With this decision, the Casanare Administrative Court resolves the case presented by Reyes Emilio Guanaro Vargas against Jhon Jairo Peynado Correa and the Colombian Liberal Party.
