A police report of the shooting that left two officers wounded indicated that a third officer was at the scene and that at least 20 shots were exchanged the day of the incident at a hotel in San Jose.

According to police, the third officer identified as Dodge was on the third floor with officers Joseph Desroches and Jaime Arredondo when the shooting occurred on Thursday night.

A hotel guest called to report that a man with a restraining order was on his way to her location.

It would have been the suspect identified as Kevin Briones, 33, who has a long criminal history, including alleged domestic violence and sexual crimes against the aforementioned guest.

However, court documents do not show that a restraining order was filed.

“No, he should not have been on the streets,” said Catherine Alvarez, vice president of SJPOA.

The police union said Briones should have been kept behind bars on previous charges.

Telemundo 48 showed the legal documents to analyst Steven Clark.

“When we look at Briones’ criminal history, he doesn’t appear to be someone who would be behind bars at the same time the shooting happened, but it’s still too early to tell,” Clark said.

The police report also shows that Briones opened fire on the officers 8 times, while Officer Desroches fired 11 times.

Both uniformed officers were taken to the hospital.

“They are both in good spirits, I spoke with both of them this morning and they appreciate all the support and prayers from the people,” Alvarez said.
