The prosecutor of Investigation No. 4, Federico Aldeco, brought to trial the case against police officer Franco Ávalos, accused of the death of his colleague, Oscar “Jerry” Ramírez.

The representative of the Public Prosecutor’s Office (MPF) completed the preparatory criminal investigation and prepared the request for a summons to the accused’s trial. Ávalos’ defense, carried out by lawyer Roberto Mazzucco, opposed the elevation to trial.

On the other hand, today will also be a key day for the cause. The jurisdictional control hearing will be held in the Guarantee Control Court No. 1, led by Judge Héctor Rodolfo Maidana. On that occasion, Ávalos’ defense will request the release of the accused, according to the information accessed by El Ancasti. The hearing was scheduled for last Tuesday, but had been suspended at the request of the complaint and was rescheduled.

In the procedural act there will be the investigator Aldeco and the plaintiff lawyer, Daniel Ortega, who will have the possibility of arguing and supporting or rejecting Mazzucco’s claims.

In addition, Oscar Ramírez, who is the father of “Jerry,” spoke yesterday. In dialogue with the press, he narrated the difficulties he had in accessing information about the case during the process.

“I understand that at least the prosecutor should have given me a written report every time the issue regarding my son is discussed. “They murdered my son and I have no part in anything,” he said.

Then, Ramírez pointed out that Ávalos “has violated security measures” and from the defense “they want to justify the unjustifiable, they can never say that it was an accident.”

As detailed, the injury that “Jerry” suffered was “a shot between the eyes, in the forehead, dispersing towards the left eye upwards.”

Finally, he addressed the witnesses to the event. “The only witnesses are police officers. I am not asking you to add something in favor of my son or to take anything away from him. “I want them to testify to what really happened there,” he asked.

Mazzucco, on his own, provided statements to El Ancasti and explained why the defense considers that Ávalos should be released. “Our main foundation is that there is no procedural danger. In this case, preventive detention was valued at the time above all (due to) the circumstance that he is a police officer and that, if he regained his freedom, with respect to the rest of the witnesses who were also his colleagues and most of his subordinates, he would be There was a risk that he could exercise his hierarchy within the police vertical and could influence these testimonies, alter or hinder the investigation. Franco resigned from the Police a while ago. He is surely going to accept that resignation. So, he doesn’t have the character, the police hierarchy. So, part of the most important foundations that Justice used to dictate his preventive detention fall apart. It is not justified that he continues to be detained,” he assured.

Case

Ávalos is being investigated for the death of Ramírez, who died after being shot in the head.

It happened on Friday, June 2, 2023 in the building of the Rapid Action Motorized Infantry Group (GIMAR), located in the Capital city.

It happened at the time when Ávalos was handling a firearm, according to the investigation.

For this fact, Ávalos is charged with the crime of “simple homicide with possible intent aggravated by the use of a firearm.”

He is detained under preventive detention in the Provincial Penitentiary Service (SPP) of Miraflores, in the Capayán department.

He admitted – to investigators – that he shot Ramírez. n
