The Justice of Córdoba ordered Club Atlético Belgrano to immediately grant a free pass to a ten-year-old boy who participates in the lower divisions.

The ruling stipulates that the pass must be granted once the boy’s parents reliably demonstrate the change of family residence, the identification of the people with whom the child will live, the educational establishment he will attend and the new club where he will continue. with their federated soccer practice. It is crucial to note that without this pass, the child cannot play for another club affiliated with the Argentine Football Association (AFA).

Judge María de los Angeles Morello, head of the Associated Management Court No. 1, thus responded to an action for protection presented by the child’s parents, and ruled that the club must grant the amateur player a free pass unconditionally, allowing him thus enjoying full freedom to continue his football career in another club.

The parents argued that the family’s impending move to another city and the lack of a professional contract between the parties justified this request.

For his part, Belgrano alleged that no other sports institution had requested the player and that the parents had not specified which city they would move to or when, which prevented them from making a decision for the child’s benefit.

Judge Morello highlighted the lack of clear regulations in the AFA regarding passes and transfers of minors who play soccer in a federated manner. Despite these regulatory omissions, she emphasized that no child should be subject to adult decisions that limit her sporting development, and stressed that children’s sports practice should not be subject to commercialization.

Consequently, the judge urged the AFA to modify its regulations quickly and effectively, with specialized advice on childhood issues, to regulate in detail activities related to minors in football.

Finally, the ruling highlights the importance of building clear regulations that protect the constitutional rights and guarantees of children and adolescents, always prioritizing their well-being and development.
