He prosecutor Mario Burgos He has been involved in multiple scandals, after the National Judicial Disciplinary Commission formulated charges against him on June 7 for alleged irregularities in the case being carried out against Nicolás Petro Burgos, son of President Gustavo Petro.

In the midst of the disciplinary investigation for the alleged irregularities in the investigation against Nicolás Petro, Burgos has declared that he feels persecution and has directly pointed out President Gustavo Petro and his son Nicolás as his only enemies. “The only enemy I have today (…) is the President and the President’s son”reads the document resulting from the free version that Burgos grants to the Judicial Disciplinary Council.

However, prosecutor Burgos, in conversation with El Colombiano, said that the phrase would be out of context, “that he had no enemies, just for this case and that’s it”.

The disciplinary process began on October 12, 2023 and continues to determine whether Burgos’ actions warrant sanctions or if Nicolás Petro’s case should be archived. The accusations against him include the possible leak of videos related to the investigation for money laundering and illicit enrichment of Nicolás Petro, as well as alleged undue pressure to reach a judicial agreement. Furthermore, he is accused of exceeding his duties by questioning Nicolás Petro about the responsibility of the President of the Republic, Gustavo Petro, in which Burgos had no jurisdiction.

The case became complicated for Burgos after, during an interrogation on August 2, 2023, Nicolás Petro answered questions about the presidential campaign and other matters related to the investigation. Questions to which Burgos stated that he was aware of not being able to directly investigate the president, but he maintained that asking such questions was part of his job to clarify the facts and determine the relevance of the information. According to him, it did not constitute an abuse of his functions.

Subsequently, on December 4, 2023, Nicolás Petro reiterated the accusations against his father in a testimonial proceeding. However, everything stopped when President Gustavo Petro visited his son the next day, changing the direction of the case and leading to the opening of the disciplinary investigation against prosecutor Burgos.

Burgos’ defense continues to argue that his client has not committed any irregularity and that his actions fell within his legal powers.
