According to the JEP, Valle Anaya was sentenced, in 2017, to 40 years in prison in the ordinary justice system for the murder of the sociologist and university professor, Alfredo Rafael Francisco Correa de Andráis, and his escort, Edelberto Ochoa Martínezin 2004.
The Chamber for Defining Legal Situations made an assessment of the truth contributions presented by Valle Anaya in his Commitment, Clear, Concrete and Programmed (CCCP), which is part of the JEP’s conditionality regime.

The murdered teacher, Correa de Andráis, was a member of the Union Association of Teachers of the Simón Bolívar University (Asoprosimbol).
This special justice referred to the fact that, at the time of the events, as has been established in different judicial investigations, officials of the extinct DAS, headed by Jorge Noguera, prepared lists of people accusing them of being collaborators of the guerrilla and then they were murdered in operations. executed by paramilitaries from the Northern Block, with the collaboration of members of the public force.

These reasons also allowed the court to consider that the truthful contributions that Valle Anaya makes to the JEP may be of interest and usefulness for Case 08, which investigates crimes committed by the Public Force or by other agents of the State, in association with paramilitaries or civilian third parties, within the framework of the conflict.
“Therefore, the court accepted his submission as a voluntary participant as a State agent not a member of the public force.“, highlighted the JEP.
The room, on the other hand, decided not to grant Valle Anaya the benefit of temporary, conditioned and anticipated freedom until he expands his contributions to the full truth, offer guarantees of reparation to victims “that are acceptable and that correspond with their recognition of responsibility and the damage caused.” Likewise, Valle Anaya must specify the guarantees of non-repetition, which will be the subject of study by the court.

Valle Anaya had been outside the country, in the United States, since 2005. He was captured in that country by immigration authorities in 2018 and deported to Colombia in September 2022. Since then, he has been deprived of his freedom.
The jEP explained that this decision was made by the majority by Working Group A, of the Special Subchamber of Knowledge and Decision for voluntary appearing parties and for paramilitary commanders functionally and materially incorporated into the Public Force (SUBCVCP), which is made up of judges Sandra Castro Ospina and Claudia Saldaña Montoya, and the magistrates Mauricio García Cadena and Pedro Díaz Romero, who registered a rescue vote.
