He added that the accused “he carried out a maneuver to his left, causing him to enter the opposite lane of Route 40, thus invading the circulation space of the truck. that was circulating in the opposite direction.” This maneuver is what, in the opinion of the prosecution, generated the head-on collision between the truck and the van, and caused the death of the four members of the Linares family.

After recounting the theory of the case, De Lillo framed the accusation as the crime of manslaughter, caused by the reckless driving of a motor vehicle.aggravated by the number of fatalities.

In addition, De Lillo asked Judge Bibiana Ojeda to impose preventive detention for the Brazilian driver, because he is a defendant of another nationality who has no roots or residence in the country. In any case, the judge rejected the preventive detention requested by the prosecutor and set the investigation period at 4 months.

Instead, Ojeda issued a ban on leaving the country for the accused and, at the request of the defense, ordered that the accused establish a domicile in Bariloche, where he must appear every day at a police station.

This week, the defense requested that the truck driver be able to return to his country. The official defender Sol Valero proposed that De Peder Da Silva be forced to go to Argentina or sign in an entity in Londrina, where the accused has his domicile. The request was rejected by Judge Ignacio Pombo and the measures ordered in early June by Ojeda remained in force.
