Starting this Wednesday, the young man who on July 27, 2018 caused the death of another driver in a head-on collision on the N-111 will face thirteen years in prison and nine years of deprivation of the right to drive motor vehicles and … mopeds. The request is formulated by the Prosecutor’s Office that charges him with the crimes of reckless driving with manifest disregard for the lives of others, in conjunction with a crime of driving under the influence of alcoholic beverages and, in turn, in conjunction with another of intentional homicide. .
In terms of civil liability, the public prosecution demands that both the defendant and the insurance company jointly and severally compensate the parents and siblings of the victim in 520,000 euros. 20,000 for each of the parents and 60,000 for each of the eight siblings. The Public Ministry points to the owner of the vehicle as subsidiary responsible for compensation.
The event, according to the Prosecutor’s Office in its indictment, occurred on July 27, 2018. That day, the defendant, who was 29 years old at the time, was driving an Audi vehicle, owned by his father, under the influence of alcoholic beverages and benzodiazepines that they had previously ingested and that “limited their psychophysical abilities.”
The young man had left the Soria town of Aylloncillo around 12:30 p.m. and after spending some time in the city of Soria, around 3:00 p.m., he began the journey to Logroño. The accused “was driving aggressively and erratically, putting the lives and physical integrity of other road users at risk,” the prosecutor points out. In such a way that near Villanueva de Cameros several drivers had to maneuver suddenly to avoid colliding with the defendant’s vehicle.
Near Peñaclara, in Torrecilla in Cameros, he was about to collide with another driver when he overtook a vehicle without indicating the maneuver and abruptly leaving his lane. At the height of Albelda, he overtook ten cars at the same time and finally, around 4:20 p.m., at the height of kilometer point 312,250 of the N-111, in the municipality of Nalda, “suddenly and abruptly, without checking “if vehicles were traveling in the opposite direction,” he moved his car towards the center of the road and invaded the opposite direction of traffic in which a Ford brand car, Focus model, was traveling, with which he collided head-on without making any evasive maneuver. As a result of the accident, the driver, 31 years old, and the sole occupant of the Ford, died instantly.
The defendant, at that time, had a blood alcohol level of 1.44 grams equivalent to a breath alcohol level of 0.72 milligrams per liter. The accident, the prosecutor states, occurred on a straight stretch with good visibility, the weather conditions were favorable and the road was dry, clean and free of obstacles.
Six women and three men will judge the case
