The drama of the relatives of Rosa Emelina Peralta Fernández, the Colombian lawyer, grows found dead 11 days ago in her residence in Spain, because they have not been able to claim his body and begin the repatriation process to Colombia due to the lack of a lawyer and resources to cover expenses that exceed 25 million pesos.

Rosa Emelina Peralta, 38 years old and originally from Fonsecawas found dead on Monday, June 10, with signs of mechanical asphyxiation near a window in the living room of her residence in Hondón de las Nieves, Alicante (Spain).

She had lived there for six months with her husband, Sergio Torres González, and his three children, ages 14, 12 and 5.

We urgently need a lawyer there to deliver a copy of the file to the court, otherwise they will not deliver it.

Her family has asked the Spanish authorities to thoroughly investigate what happened; they do not believe she committed suicide, as her husband said. They report that it was a feminicide, since she was apparently subjected by her partner to constant physical and verbal abuse.

“They have not yet told us what my sister died of, the forensic medicine report is missing to know if it was feminicide or suicide, we are with that anguish and the anguish of bringing our sister to Colombia to give her a Christian burial,” said one of her brothers, in dialogue with El Tiempo and has requested the reservation of his name.

The anguish of this family increases every day, since they do not have anyone they trust in Spain who can help them, they do not know where to find a lawyer to handle the repatriation process, to be in charge of the investigation of the case and the process. of custody of Rosa Emelina’s three children, who are in that country together with their father, who has also told them that he has no resources.

“We urgently need a lawyer there so that they can give us a copy of the file in court, otherwise they won’t deliver it,” said another of his brothers.

They also explained that, this Wednesday, they received a response from the Foreign Ministry stating that they cannot support them with resources in Rosa’s repatriation and they undertake to analyze the issue of her three minor children, to see if they can be repatriated at the request of her family.

“They told us that they would be pending in court to expedite the process of delivering the remains, but they are not going to intervene with a lawyer, that is practically nothing, they do not help us with anything,” said the relative.

Although he has calmed down a bit, today he told us that the day he sees his daughter, he doesn’t know if he will be able to endure it, she was the only female and the youngest of his children.

Added to this is the lack of resources, thanks to the solidarity of family, friends and people who have known about this case, they have managed to collect half of the money, but more is missing.

So again, her three brothers are calling on those who wish to collaborate with them to fulfill their mother Aidé Fernández’s dream of giving her only daughter a Christian burial. The news of his sudden death has her devastated and somewhat upset.

Although he has calmed down a bit, today he told us that the day he sees his daughter, he doesn’t know if he will be able to endure it, she was the only female and the youngest of his children.“, indicated another of Rosa’s brothers.

There are reports of domestic violence

His brother has asked the Spanish authorities to thoroughly investigate this fact, because there is a history of domestic violence by his partner and that at the time they were reported to the Fonseca Family Police Station and another to the Girón Prosecutor’s Office ( Santander). The last complaint was filed by Rosa’s family in September 2023.

The constant verbal and physical abuse from her partner generated a depressive condition in Rosa, who was confined to a rest center.

“We had to go look for my sister and put her in a nursing home because she was very bad psychologically, she didn’t eat or bathe because of all the abuse she received,” said the victim’s loved one.

Last December Rosa left the nursing home and in January decided to give her marriage a new chance. and change her life, traveling to Spain with many dreams with her three children and her husband, which were tragically cut short.

“It could be a femicide, which is something very delicate. The authorities are the ones who will have to confirm whether it was like this or not,” the brother said.

Before her death, Rosa had already expressed to her mother and cousins via chat some cases of domestic abuse by her partner and her desire to return to Colombia.
