The Federal Justice in Córdoba ordered the ANSES to update a retirement asset by applying inflation, after the presentation of a pensioner in May 2023, based on the formula of the Government of Alberto Fernández that did not cover the Consumer Price Index (CPI) .
Following the presentation of a 73-year-old pensioner from the city of Alta Gracia, the judge declared unconstitutional the mobility formula 27.609 that was dictated during the previous administration.

Lawyer Carla Simón, part of the Jorge Gentile law firm that represents her, told Chain 3 which is a “fair, novel and important ruling for retirees.”
“It declares the mobility formula of Law 27,609 unconstitutional, since it does not contemplate the consumer price index, which led to a significant deterioration of pension assets,” he indicated.
The lawyer stressed that mobility was based on tax collection and the INDEC salary index, but not on the CPI. “In such strong inflationary processes, assets were outdated and far behind,” she stressed.
According to what he was able to find out Chain 3, ANSES will appeal the Court’s decision.
