Despite declaring the inadmissibility of the INDH complaint for possible influence peddling, the Seventh Guarantee Court of Santiago warned that all the facts contained therein constitute a crime.

The National Institute of Human Rights (INDH) will appeal the decision of the Seventh Guarantee Court of Santiago, which dismissed the agency’s complaint against those responsible for the crime of influence peddling. The complaint contained the name of Mario Desbordes (RN), current candidate for mayor of Santiago.

The INDH’s legal action was filed after conversations between the former Minister of Defense and the former Minister of the Court of Appeals of Santiago, Juan Antonio Poblete, were revealed. Poblete asked him to support the appointment of María Teresa Leterlier as Minister of the Supreme Court, a position she currently holds.

The acting head of the INDH’s Rights Protection Unit, David Bahamondes, said that “this court ruling, regarding the institute’s admissibility as an active plaintiff in this case, is what we are going to appeal.”

Also, he argued that they will “enforce the arguments we have as an institution regarding the legitimacy of our participation, supported by multiple causes.”

RN questions INDH for complaint against Desbordes

On the contrary, Mario Desbordes appreciated the decision and assured that “the INDH’s complaint did not apply. Why? Because the INDH has no powers.”

“They committed a crime called malfeasance and I will not stop until they are punished,” he added.

Along the same lines, the lawyer of the former president of Renovación Nacional, Agustín Mardones, commented that “this resolution is very important since we filed a complaint against the National Institute of Human Rights, and whoever is responsible for the accusations made against my client, and that complaint has now been declared admissible in the Eighth Court of Guarantees.”

Also, from this political sector they requested the resignation of the president of the board of directors of the INDH, Consuelo Contreras. This was expressed by representative Ximena Ossandón, who pointed out that “it is confirmed that the INDH does not protect or promote human rights. “It violates them through whimsical criminal prosecutions, whether of police officers or political adversaries.”
