Oscorima had submitted a resource of protection of rights, claiming that his right to due process was being violated and that open investigation should be suspended against him. However, the Permanent Criminal Chamber of the Supreme Court, chaired by César San Martín, dismissed these arguments and confirmed that the investigation against him should continue.
In the judicial resolution to which this media accessed it is established that Oscorima Wilfredowho has no immunity, must be investigated and tried by an ordinary prosecutor. “The existing connection between the facts attributed to the president of the Republic is not under discussion, Dina Boluarte Zegarraand the appellant Wilfredo Oscorima Núñez. In both cases it is a crime of bribery (…) and separating the imputations does not affect the investigation for the other two crimes imputed to the president of the Republic. (…) In the case of Wilfredo Oscorima, he is a public official not constitutionally agreed and (…) did not transgress the criminal procedural legality by not being submitted to a procedure other than the previously established, ”reads the document.
Oscorima sought to take refuge in the shadow of Boluarte so as not to be investigated
In statements for the Republic, lawyer César Nakazaki explained that the defense strategy of Wilfredo Oscorima would have been to stay linked to the process of President Dina Boluarte to avoid being processed independently.
-“He should hide in the shadow of the president, because the president cannot process it until they raise immunity. Then, if they leave him alone, they investigate him, they process it. There is nothing to develop the criminal case,” said the lawyer.
Nakazaki also added that Oscorima’s intention was to prolong his permanence in preliminary research stage. “I deduce that what the defense of Oscorima seeks is to protect in the shadow of the president, while they do not raise immunity, the case is under preliminary investigation, and, therefore, ‘I am calm.’ Instead, if they put me in a process to me alone, as a regional governor, I have no constitutional protection,” he said.
