This situation occurred after Franco Vargas lost his life after an instruction march from the Pacollo Training Camp to the Putre Military Corps.

The repercussions of the case of the conscripts of the “Motorized Brigade No. 24 Huamachuco” of Putre continue. Franco Vargas’ family seeks to have his death investigated by ordinary justice and not by military justice.

The above, after the 19-year-old lost his life after an instruction march from the Pacollo Training Camp to the Putre Military Corps.

Faced with this situation, there are two complaints filed in the ordinary courts. The first was carried out by the National Institute of Human Rights (INDH) before the Arica Prosecutor’s Office, where they accused violation of human rights, as a result of the exposure of people not trained for training and without appropriate clothing, with the consequent illegitimate coercion or cruel, inhuman or degrading treatment, established in the Penal Code.

Despite opening a case, the prosecutor’s office has not yet initiated an investigation. Prosecutor Mario Carrera commented that “as the Prosecutor’s Office we have the duty, in the face of any complaint, from any institution or person, to generate an investigation, assign a prosecutor and carry out some diligence to make a decision, then informed regarding this person or institution. ”.

Meanwhile, the second judicial action was carried out by the family of Franco Vargas. Likewise, Romy Vargas, the mother of the deceased young man, attended the Senate Human Rights Commission and demanded justice. “The Chilean Army has to take care of its compatriots, not torture them (…) I want prison for them,” she said.

For his part, the Vargas family’s defense lawyer, Sebastián Andrade, maintained that the case should be investigated by ordinary and not military justice. “There is no due process in a procedure in which the victim does not exist. In the Military Prosecutor’s Office there is no figure of the victim. There is no figure of the complainant. There is no possibility of repair. There is an interested party and Mrs. Romy is not an interested party.”
