This Monday, a trial began in the Oral Criminal Court of La Serena against a subject accused of the crimes of not reporting a traffic accident and attempted homicide against Carabineros in the exercise of their duties.
According to the accusation of prosecutor Carlos Vidal Mercado, the events date back to February 25, 2023 when, around noon, on Brasil Street, the accused, with the initials PART, who was driving a Haima brand vehicle along with two other subjects , was inspected by Carabineros personnel.
However, during the control, and when consulted about the car’s documentation, the individuals were not able to explain the origin of the vehicle.
However, and as Carabineros was able to identify, the vehicle in which these subjects were traveling was charged with robbery.
Indeed, the complaint had been filed on February 22, 2023, at 11:45 p.m., in the city of La Serena, as established in the police report.
But, at that moment, “and with the intention of killing the first corporal of the Carabineros who was positioned behind the car that (the accused) was driving” – as established by the Public Ministry – the driver accelerated the cell phone in reverse, at high speed, crashing. against the motorcycle of one of the police officers.
Then, and without paying attention to the arrest order, the accused fled the scene in the same car along Brasil Street, but upon reaching O’Higgins, they collided again with two other vehicles that were waiting for the green light at the traffic light. that corner
Quickly, the defendants got out of the car, trying to flee on foot. However, they managed to be subdued by Carabineros after firing some shots at the individuals.
START OF THE ORAL TRIAL
After the respective investigation, yesterday the first day of arguments of the trial was held, with the accused PART and his co-pilot, FPCA, going up to testify.
When interrogated, PART., admitted having been shot by a police officer, justifying his actions because he had a case pending with the justice system – of which he was finally dismissed – choosing to “escape” from the control of the Carabineros.
In this context, Carlos Vidal Mercado, chief prosecutor of La Serena, pointed out that the trial is taking place “for facts constituting the crime of attempted homicide, against a Carabineros official, while police personnel were trying to carry out a control.” to a vehicle.”
Vidal added that the car, “instead of obeying the orders of the Carabineros, reverses, attacks the motorist who manages to avoid the impact of the vehicle, who continues to flee, at which point it hits two more vehicles, and then the occupants get out so that Carabineros can catch up with them,” added the persecutor.
REQUESTED PENALTIES
In this regard, the prosecutor explained that in light of this fact, two crimes are identified: one, based on the fact that the defendants were traveling in a vehicle that had been commissioned for theft, “therefore, a custodial sentence is requested regarding the driver and co-pilot.” of freedom of 4 years of minor imprisonment in its maximum degree, plus the accessories, which is what the law establishes,” he said,
And second, there is the crime of attempted homicide against a Carabineros official, for which the Public Ministry is asking for 7 years with respect to the driver, in addition to the special crimes by the Traffic Law, because after giving the arrest warrant, the defendants fled the scene.
The trial is expected to last until today, and then the court’s verdict and eventual sentence will be heard.
