Context: Former Foreign Minister Álvaro Leyva and former Prosecutor Eduardo Montealegre have said that in compliance with the Peace Agreement with the FARC, the president could convene a Constituent Assembly by decree. It is a thesis that has already been overturned by the Constitutional Court and that former president Juan Manuel Santos has denied.

What does the former prosecutor say? Last week, Montealegre defended the constituent’s proposal to extend the presidential term, calling it “totally legitimate.”

He explained that, according to the Vienna Convention, the State is obliged to comply with and adjust its internal regulations to guarantee compliance with the Agreement. And, since Congress would be “blocked” from advancing the reforms, according to him, “the only way out is the constituent assembly.”

What happened now? Montealegre insisted on that thesis in a press conference. He said that the 2016 Peace Agreement is of a “special” nature, so it must respect International Humanitarian Law and the Geneva Convention.

The former prosecutor added that in the constituent assembly there is the possibility of establishing “immediate re-election” and extending the term of office.

He also assured that he has not had any contact with President Petro or the Ministry of Justice. “I speak as an academic, as a citizen,” he reiterated.
