Complying with a court order according to the ruling of the popular action filed No. 54-001-33-31-005-2007-00182-00the First Oral Administrative Court of the Tunja Circuit, declared the municipality of San José de Cúcuta financially responsible of the damages caused to the group made up of the owners of the surrounding motorcycles in the aforementioned municipality, who made payments derived from the stipend for updating the database of motorcycles created by the Decree 0400 of September 11, 2006 and the Resolution No. 0396 of September 19 of that same year, for the improper execution of the aforementioned administrative acts materialized in the collection made by virtue of said acts between the years 2006 and 2007 in the administration of Mayor Ramiro Suárez.

Taking into account the above, The municipality of San José de Cúcuta was ordered to pay the members of the plaintiff group the sum of $677,657,577 million pesos for the consequential damage derived from the payment of fines, towing service and parking that were imposed for the non-payment of the stipend of the following values ​​for individual compensation:

  • The sum of ONE HUNDRED SEVENTY-EIGHT THOUSAND EIGHT HUNDRED SEVENTY-FOUR PESOS M/CTE ($178,874) for the consequential damage derived from the payment of the fine imposed in 2006 in full, for failure to update the motorcycle database ordered in Decree 0400 of September 11, 2006 and Resolution No. 0396 of September 19 September of that same year.
  • The sum of ONE HUNDRED THIRTY-FOUR THOUSAND ONE HUNDRED FIFTY-FIVE PESOS M/CTE ($134,155) for the consequential damage derived from the payment of the fine imposed in 2006 in 75% of the value, for failure to update the motorcycle database ordered in Decree 0400 of September 11, 2006 and Resolution No 0396 on September 19 of that same year.
  • The sum of EIGHTY-NINE THOUSAND FOUR HUNDRED THIRTY-SEVEN PESOS M/CTE ($89,437) for the consequential damage derived from the payment of the fine imposed in 2006 in 50% of the value, for failure to update the motorcycle database ordered in Decree 0400 of September 11, 2006 and Resolution No 0396 on September 19 of that same year.
  • The sum of ONE HUNDRED EIGHTY-NINE THOUSAND SEVEN HUNDRED ELEVEN PESOS M/CTE ($189,711) for the consequential damage derived from the payment of the fine imposed 200% in its entirety, for failure to update the motorcycle database ordered in Decree 0400 of September 11, 2006 and Resolution No 0396 of 19 September of that same year.
  • The sum of ONE HUNDRED FORTY-TWO THOUSAND TWO HUNDRED AND EIGHTY-THREE PESOS M/CTE ($142,283) for the consequential damage derived from the payment of the fine imposed in 2007 in 75% of the value, for failure to update the motorcycle database ordered in Decree 0400 of September 11, 2006 and Resolution No 0396 on September 19 of that same year.
  • The sum of NINETY-FOUR THOUSAND EIGHT HUNDRED FIFTY-SIX PESOS M/CTE ($94,856) for the consequential damage derived from the payment of the fine imposed in 2007 in 50% of the value, for failure to update the motorcycle database ordered in Decree 0400 of September 11, 2006 and Resolution No 0396 on September 19 of that same year.
  • The sum of FORTY-THREE THOUSAND FOUR HUNDRED THREE PESOS M/CTE ($43,403) for consequential damage derived from the payment of tow truck service.
  • The sum of TWELVE THOUSAND THREE HUNDRED THIRTY PESOS M/CTE ($12,330) for the consequential damage derived from the payment per day of the parking service.

The action was led by lawyer Omar Javier García and other jurists from the city of Cúcuta, in a decision of legal significance and social importance where illegal acts are reproached, where the trust of the citizens of Cucuteño was violated by imposing irregular economic charges.

At the time, the person who served as traffic secretary at the time was Cesar Omar Rojas Ayala.
