The Nation was saved from paying 20 million dollars that the Sociedad Portuaria Regional de Barranquilla SA (SPRB) and Barranquilla International Terminal Company SA (Bitco)in a lawsuit in which they alleged that Cormagdalena had failed to comply with the obligation to maintain the navigable canal of the Magdalena River.

The Council of State studied an extraordinary appeal for annulment of the arbitration award, which the port company and Bitco filed against an award from the Arbitration Court of the Arbitration and Conciliation Center of the Chamber of Commerce of Bogotá, for a decision that favored Cormagdalena.

According to these companies, Cormagdalena did not fulfill its duty to maintain adequate depth levels for navigation and port activities in the navigable access channel to the Port of Barranquilla.

Therefore, the National Legal Defense Agency of the State defended the interests of the Nation and The Council of State ruled in favor of Cormagdalenasaving the Nation from the millionaire payment to the port companies, under the argument that the annulment appeal was unfounded.
