In the ordinary session on Thursday, the State Congress will vote on the opinion of the committees Justice and Government that grant pardon by grace to Sanjuana Maldonado, confined 15 years ago in the “El Xolol” social reintegration center, in the municipality of Tancanhuitz.

The effects of the legislative decree establish that “consequently, she is granted immediate freedom, without thereby being considered innocent, of the commission of the crime for which she was prosecuted and sentenced. Please notify this Decree to the petitioner; as well as the Owner of the Executive Branch of the Stateand at State Supreme Court of Justiceto the latter for the purposes of compliance as of its entry into force.”

The Decree will enter into force on the day following its publication in the Official State Newspaper “Plan of San Luis”.

To the commissions of Justice; and Government, it was handed over to them in the Ordinary Session of February 22 of this year, which occurred in Sanjuana Maldonado Amaya.

It is the express power of the State Congress, conferred in the Political Constitution of the Free and Sovereign State of San Luis Potosígranting pardon by grace, without implying an act of review of the jurisdictional action, discretionally analyzing the facts presented by the petitioner and her particular circumstances.

In exercise of the responsibility, generosity, and grace of the Legislative Branch, the opinion says, it is appropriate to grant the pardon requested by Sanjuana Maldonado Amaya, without thereby considering himself innocent, since as already mentioned, this Legislative Branch lacks the powers to become a reviewing body of the resolutions and jurisdictional procedures emanating from the Judicial Branch of the State, and that the right has been applied correctly.

Sanjuana Maldonado Amaya, compiles a sentence of 30 years of ordinary prison and pecuniary penalty in the amount of $103,900.00 (one hundred three thousand nine hundred pesos 00/100 MN), plus compensation for the damage, once its amount is justified in execution of sentence, for the commission of the crime of aggravated kidnappingruling issued within process 59/2009 pronounced in the First Mixed Court of First Instance of the Second Judicial District in the State.

For the pardon to proceed, 14 votes are needed, which are simple majority.
