In the last few hours it became known that a former candidate for the Assembly, who was burned in his attempt, has just announced that he is starting a process to revoke the mandate against the mayor of Tunja, Mikhail Krasnov.

Well, it turns out that this is impossible to do, at least at this moment, since Law 1757 of 2015 modifies some provisions regarding the process of revoking the mandate of mayors or governors in relation to what Law 134 of 1994.

Specifically, this procedure proceeds as long as 12 months have elapsed from the moment of taking office and that there is no less than one year left before the end of the period for which he was elected. The next step is to achieve the support of 30% of the total votes obtained by the president, that is, 8,199 valid signatures (Art. 9 of Law 1757).

Paragraph 1. Art 6. of Law 1757 of 2015: Initiatives for the revocation of the mandate may be registered as long as twelve (12) months have elapsed from the moment of possession of the respective mayor or governor and no less than one year is missing. for the end of the respective constitutional period.

Next, the Civil Status Registry will design the form for collecting citizen signatures that will be delivered free of charge to the promoter of all types of proposals on citizen participation mechanisms. The support collection form must contain, at a minimum, the following data:

a) The number that the Civil Status Registry assigned to the proposal;

b) The summary of the content of the proposal, the reasons for its convenience and the invitation to potential signatories to read it before supporting it. Said summary may not contain personal references or make personal or commercial advertising;

c) Space for each citizen to fill out, in a legible manner, their support for the proposal with their name, identification number, signature and date of completion. If the person does not know how to write, he will record his support with his fingerprint;

d) The number of citizen supports that must be collected by the promoter;

e) The date on which the deadline for collecting citizen support for the proposal expires.

But additionally, after valid signatures are reached, elections will be called. In this case, if it occurs, more than 36,000 Tunjanos must vote and in the count of valid votes more than half of those ballots must agree that the mayor must leave office.

“In the Revocation of the Mandate, the popular pronouncement by half plus one of the citizen votes that participate in the respective call, provided that the number of votes is not less than forty (40%) of the total valid vote registered on the day on which the respective leader was elected. If as a result of the vote the mandate of the governor or mayor is not revoked, it cannot be attempted again during the remainder of their term,” the Law clearly states.
