With the continuation of this regulation, the working day goes from 47 to 46 hours per week. This in compliance with the law that seeks to reach a maximum working day of 42 hours per week.

This reduction, in addition to being a social benefit for employees, by working one hour less compared to the current day, also respects the monthly salary that workers receive, that is, the fact that they work less, It doesn’t mean they will have less income.

Employees will receive more money for overtime

According to the Ministry of Labor, as of July 15, 2024 the calculation of the value of the ordinary working hour It will be done by dividing the worker’s monthly salary by 230 working hours per month.

So, for those who earn the minimum wage, equivalent to 1,300,000 pesos, the hour worked will have a value of 5,652 pesos. Being so, With the new work day, the value of the additional hours will change.

The extra daytime hour, which is the ordinary hour plus a 25% surcharge, will have a value of 7,065 pesos. For its part, the extra nighttime hour, which adds an additional 75%, it will be paid at 9,891 pesos.

It is noteworthy that law 2101 of 2021, which modifies the article 161 of the Substantive Labor Code, seeks that the reduction be done gradually.

  • 2023: The working day was reduced to 47 hours per week.
  • 2024: Will reduce to 46 hours
  • 2025: Will reduce to 44 hours
  • 2026: It will be reduced to 42 hours.

However, this regulation takes away one of the benefits most anticipated by employees: Family Day, on behalf of the gradual implementation of the reduction of working hours.

Who will not be beneficiaries of the Reduction in Working Hours?

According to the vice minister of labor relations and inspection, Edwin Palma, this regulation would not apply to:

  • Public servants who work in state companies and whose labor relations are established by the Substantive Labor Code
  • Nor does it represent a change or affect the workday of employees who have special schedules, that is, those who They do not complete 8 hours of work per day.
  • Minors who work with an employment contract and They have a permit from the Ministry of Labor.
