The Chubut Ombudsman confirmed this Tuesday that the Federal Justice has rejected the protection filed by the owner, Claudia Bard, for increases in gas rates in the province.

In this context, the organization confirmed that the decision will be appealed “so that our active legitimacy in the defense of the collective rights of the people of Chubut is recognized.”

The Interlocutory Sentence was issued by the Federal Court No. 1 of Rawson, where it sought to “regulate” the entry into force of measures 122 and 41 of ENARGAS and the Ministry of Energy of the Nation, which defined considerable increases in gas rates. natural in Chubut. Specifically, the ruling rejects the “active legitimation” by the Ombudsman’s Office for “the active defense of the collective rights of Chubut citizens.”

According to what was reported by the Ombudsman’s Office, the Federal Justice considered that “the provinces and municipalities can only create bodies to act within the scope of their respective powers, without being able to invade those that correspond to the federal Government, or to other provinces or municipalities. “.

For this reason, “when provinces create local ombudsmen, they can only create control bodies for their own administrations, but no province or municipality is empowered to create a body that interferes with the actions of the National Public Administration. In fact, the defenders of the people do not have political representation of the people nor are they custodians of the rights of the people. They are control bodies that local administrations have established to control the progress of their own administrations,” the ruling states.

Faced with this, the Chubut Ombudsman considered that ““It is necessary to defend the interests of our citizens before that court, since only the Ombudsman of the Nation would be actively legitimized to intervene in these cases, a position that is vacant.”

At this point, he stressed that it generates ““a state of defenselessness for the citizens of the provinces who see their rights overwhelmed by the abusive actions of the National State.”

Faced with this, it was confirmed that in the next few hours the resolution of Judge Hugo Sastre will be appealed, “so that our active legitimacy in the defense of the collective rights of the people of Chubut is recognized,” the statement closes.
