This Saturday came into force the reform to the Amnesty Lawwhich gives the Republic President the faculty of exonerate to people who contribute to clarify crimes relevant to the Mexican State.

The decree published in the previous evening edition in the Official Journal of the Federation (DOF), a article 9 to the Amnesty Law, which is as follows:

“By exclusive determination of the person holding the Federal Executive Branch, the benefit of amnesty may be granted directly, without being subject to the procedure established in this order, in specific cases that meet the following conditions:

I. That the amnesty be granted to people who provide verifiable elements that are useful to know the truth of the facts in cases that are relevant to the Mexican State, and

II. That criminal action has been taken against the person or persons to whom the amnesty is granted, they are being prosecuted or are being sentenced for any crime.

It was noted that in the cases referred to in this provision, the provisions of Article 2 of this Law will not be applicable.

“The amnesty granted in terms of the provisions of this article will extinguish the criminal actions and sanctions imposed,” was indicated in the decree signed by President Andrés Manuel López Obrador.

This reform was approved in the Chamber of Deputies on April 25, with 250 votes in favor and 197 against.

Also came into force today Protection Lawwhich grants the exceptional power that Mexican judges have to grant general suspensions to a rule that could have some social repercussion.

Likewise, he adds that when it comes to a protection trial against any unconstitutionality of general norms, “in no case will the suspensions issued establish general effects.”

This limits judges from granting provisional or definitive suspensions with general effects when they hear protections against laws issued by the Mexican Congress or State Congresses.
