On June 5, 2024, the regulations were published in the Official Gazette and came into force. Resolutions No. 90, 91, 92 and 93 of 2024 of the Ministry of Energy with the new Seasonal Price of Electric Energy (“PEST”) corresponding to the winter seasonal programming and the new prices for gas in the Entry Point to the Transportation System (“PIST”) that will take effect from June 1, 2024.

Resolution No. 90/2024 establishes a reduction in consumption caps with a subsidy for medium (N3) and low (N2) income users during the Transition Period (from June 1 to November 30, 2024) .

For its part, Resolution No. 91/2024 extends the consumption limits established for Level 3 users in Resolution No. 686/2022 of the Ministry of Energy (“base consumption”) to users included in Level 2 for the Transition Period for the consumption of natural gas by network. Consumption made above the “base consumption” will be considered “excess consumption” for the purposes of the bonus to be applied to the Energy component that will be transferred to the rates. The bonuses to be applied during the Transition Period to the price of natural gas in the PIST are established to be transferred to the final rates.

Regarding Resolution No. 92/2024, it approves the Definitive Winter Seasonal Programming for the MEM and the MEMSTDF, submitted by CAMMESA. The Resolution increased the PEST for all residential users to $57,214 per megawatt hour (MWh). The N1, like businesses and industries, will pay 100% of the cost of electricity, the N2 will have a 71.9% bonus up to 250 kWh/month and the N2 55.9% up to 350 kWh/month on that price on the invoice. This value will apply from May to October.

In addition, Resolution No. 93/2024 establishes the price of gas in the PIST to be transferred to end users in relation to current supply contracts or agreements concluded within the framework of the Gas.Ar Plan approved by Decree No. 892. /2020, for gas consumption made from the month of June.

Finally, it establishes that ENARSA, the producing companies and the distributors and/or subdistributors of natural gas through networks that have entered into contracts or supply agreements within the framework of the Gas.Ar Plan. They must adapt said instruments within a period of 5 calendar days in accordance with the provisions of the previous paragraph and present them to the Ministry of Energy and to ENARGAS.
