Did you apply for a credit or a deferred purchase in installments and were denied? Did they tell you that it was reported in DataCrédito and you didn’t know it? Be careful because you have the right to know what information about you rests in the country’s risk centers.

According to the criteria of

Colombians who fail to pay a loan, their cell phone data plan or another type of obligation with any entity may be reported to a risk center.

DataCrédito, from the multinational Experian, is one of those centers. It collects the banking information of millions of citizens provided by the same establishments, and with which they can analyze their financial behavior. The data, in turn, is consulted by other entities when they decide whether or not to approve any product and service.

Failure to comply with obligations with entities or banks can lead to negative reports in risk centers, such as DataCrédito.

“Being reported” does not necessarily mean having a declaration of “bad pay”, since the center also has positive reports from those who have a good credit life.

How much time should they notify me if they are going to report me to DataCrédito?

When making a financial commitment, you will be asked to sign documents in which you authorize the processing of your personal data. With this, the bank or entity will be able to make the respective reports to the risk center.

In addition to notifying him/her so that he/she can pay the obligation, the aim is to give the person time to “dispute aspects such as the amount of the obligation or fee and the due date,” added the aforementioned rule. It depends on the value of the debt you have. If it is equal to or less than 15% of a current legal minimum wage ($195,000 in 2024), the entity or bank is obliged to send you at least two communications on different days.

Law 1266 of 2008 contemplates that They must eliminate the negative report from the risk center in the following two cases:

  1. If they failed to comply with the prior communication and you have already paid what you owed.
  2. If they failed to comply with the prior communication and you have not paid. (In this situation, the bank or entity may issue the report again once the communication is sent and 20 calendar days have passed).

Remember that you have the right to complain to the entity when you evidence an inconsistency in the payment agreements or other issues of the credit, product and/or service you acquired.

How do I know if they reported me to DataCrédito?

In addition to prior communication, you can check at the corresponding establishment if there are any negative reports in DataCrédito. You can also do it directly on the risk center page:

  • Enter the official Midatacrédito portal.
  • Fill in your ID number to see if you have an active account on the portal.
  • If you do not have an account, you must register with your name, email and cell phone number. In addition, you must accept the conditions and the processing of your data.
  • Once you have a free or paid account, you can log in.
