In the first instance, the Administrative Court of Casanare decreed the loss of investiture of Jhon Jairo Peynado Correa due to the conclusion of a contract with the Government of Casanare within the year prior to the electoral elections.

The situation of the councilor of the liberal party adds to that of the current president of the Municipal Council, Michael Jonathan Castro Niño, to whom the Court also decreed loss of investiture due to violation of the regime of disabilities and incompatibilities, by signing a contract with the Government of Casanare , which he executed in Yopal, within the year prior to his election, given in October 2023.

A similar case is presented by Councilman Peynado Correa, popularly known as “Petete” in the capital of Casanareña, for which the Court determined that he incurred the disqualification of Article 43 (3) of Law No. 617 of 2000 amending Law No. 136 of 1994, by celebrating in February 2023 in Yopal the contract for the provision of professional services CDP-0317-2023 No. internal 0473 with the Government of Casanare.

Although the corporation’s defense alleged that the purpose of the contract was fulfilled in other municipalities outside of Yopal, in the study carried out by the magistrate of the evidence gathered and other evidence requested within the process, he determined that the functions were carried out in Yopal, with sporadic departures. to other municipalities.

Therefore, the Court, in a first instance ruling, decreed the loss of investiture of Jhon Jairo Peynado Correa, elected councilor of Yopal for the Liberal party for the period 2024-2027. He also denied the exception of res judicata, which was requested by the defense of the corporation.

Said order was once firmly ordered to communicate this decision to the Board of Directors of the Municipal Council of Yopal, the National Electoral Council and the National Registry of Civil Status, for the purposes of their position.

Thus, there would be two councilors who are facing the judicial process against them, both already with a ruling against them in the first instance. A third councilor, Mauricio Rozo of the Mais party, is in a similar situation, as his election has been sued for alleged double militancy; in this case, there has been no ruling.
