They ask for house arrest for the man accused of colliding and killing two agents on the South Access

In the last few hours it was learned that the defense of Hugo Martín Rodríguez Cáceres, the man who ran over and killed two agents in the South Access at the height of Godoy Cruz last Friday, he asked for prison domiciliary for his client. MDZ spoke with Pablo Cazabán, the lawyer of the accused, to know how the case will continue.

“Yesterday – Saturday – they formally charged him with simple homicide with possible intent, for two acts, in real competition,” says Cazabán, who admits that the existence and materiality of the act are not disputed, but clarifies that “what is in “The discussion is the legal qualification in a criminal law, and the evidence will have a lot of weight in that.”

He lawyer commented that “for now there is not so much evidence because we are just at the beginning of the investigation, but some testimonials have already been taken from people who were at the scene at that time, especially from preventive personnel, who were agents of Capital and of Godoy Cruzand none of them have seen the incident directly because they were busy with other tasks.

Low light and chaos: the scene at the time of the accident

One of the issues to be clarified has to do with the scene of the incident, where poor visibility and a series of previous accidents could have conditioned the actions of Rodríguez Cáceres, despite the fact that it was proven that he was driving drunk.

In this regard, Cazabán said that “it has become fairly clear that there were about three cones in the middle of the center lane, so there were now three lanes. These cones were opening from left to right, as if indicating that it was necessary to circulate on the right lane for those coming from south to north. And there was a contraventor with a luminous sword making signs from left to right, which I think could have caused confusion. Later, he commented that “from what I was able to speak with my client, it was not clear whether he had to open to the right or to the left.”

Regarding the lighting of the place, the lawyer He stated that “it was dark right in that part. You have to keep in mind that in different parts of the Southern Access the electricity is cut off because the cables have been stolen. People are driving at a certain speed with light and at one point they run out of power. light, which already generates some confusion”.

Later, he said that “there was this man with the luminous sword and there would be some elements of the previous crashes on the road. My client came in the center lane and left in the left lane, which would be the fast lane, and when he found himself That scene goes to the shoulder and continues there to avoid the cars and the intruder. That is the state of the situation that exists on the shoulder. two motorcycles, the agents and the police officer. There he runs them over.”

Finally, Cazabán states that all the police reports agree that there was a lot of darkness and that the vision was poor, while confirming that there are images from security cameras in the area, but that they contribute very little, because they are not of good quality.

The request for house arrest

Regarding his client, Rodríguez Cáceres, the lawyer defender remarked that “he has no record, neither criminal nor road, that is why I have requested the domiciliary, although I think they are going to say no to me on Monday. “I don’t think the Prosecutor’s Office grants that benefit.”

He also clarified that “it is proven that Rodríguez Cáceres was driving with positive alcohol, but the speed has not yet been determined. A police estimate that he was traveling at 90 or 100, but it is not scientifically determined. It is also not known if he braked or not, but my client says who braked and dodged. I think he may have been scared when he saw the people.

On the other hand, he commented that “we have to wait for the evidence to be incorporated. The expertise is not carried out by the Scientific Police but rather by the Criminalistics of the Judiciary, so a police officer is involved, so I don’t know how faithful the report will be, although it is do in good faith.”

Furthermore, the lawyer He confirmed that “I am going to request actions for previous crashes, since in those cases the road police intervene, whether provincial or municipal. Then I can know what the place was like at the time of the incident, such as, for example, if there were already moved to the other vehicles or not, to what place and all those circumstances”.

To conclude, Cazabán remarked that “the discussion is whether the legal classification is correct. For me, with all the criteria established by the Court in different rulings, it is an aggravated manslaughter and not a simple homicide with possible intent.”
